Terms of Service & End User License Agreement

This End User License Agreement ("Agreement") is a binding agreement between you ("End User" or "you") and Mele Apps ("Company", "we", "us"). This Agreement governs your use of the Linki mobile application ("Application") and related services, including the Linki website at applinki.com.

By installing or using the Application, you agree to be bound by this Agreement. If you do not agree, do not install or use the Application.

This Agreement is concluded between you and the Company only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Application or its content. Your use of the Application must comply with the Apple Media Services Terms and Conditions.

1. License Scope

The Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with this Agreement and the Apple Media Services Terms, on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms. For Android users, the equivalent license applies under the Google Play Terms of Service.

2. Subscriptions

Linki offers an optional auto-renewable subscription ("Linki Pro") with the following terms:

  • Subscription options: Monthly and Yearly plans. Prices are displayed in-app in your local currency and may vary by region.
  • Payment: Payment is charged to your Apple ID account (or Google account on Android) at confirmation of purchase.
  • Auto-renewal: Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.
  • Managing your subscription: You can manage or cancel your subscription by going to your Apple ID account settings (or Google Play subscriptions on Android) after purchase. Cancellation takes effect at the end of the current paid period.
  • Free trial / introductory offer: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Refunds: Refunds are handled by Apple or Google in accordance with their respective store policies.

3. Permitted Use and Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, or otherwise commercially exploit the Application;
  • Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the Application;
  • Remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) of the Company or its affiliates.

4. Intellectual Property

All intellectual property rights in and to the Application, including all associated copyrights, trademarks, and other intellectual property rights, are owned by the Company or its licensors. This Agreement does not grant you any rights to use the Company's trademarks.

5. User Content

You retain ownership of any bookmarks, links, categories, tags, notes, and other content that you create or save within the Application ("User Content"). You grant the Company a limited license to process, store, and synchronize your User Content solely to provide the Application's functionality. The Company does not sell, share, or use your User Content for advertising or third-party profiling.

6. Privacy

Your use of the Application is also governed by our Privacy Policy, available at https://applinki.com/privacy. By using the Application, you consent to the collection and use of information as described in the Privacy Policy.

7. No Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Company does not warrant that the Application will be uninterrupted, secure, or error-free, or that defects will be corrected.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR YOUR USE OF THE APPLICATION, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE.

The Company's total liability arising out of or related to this Agreement will not exceed the amount you paid for the Application in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Maintenance and Support

The Company is solely responsible for providing any maintenance and support services for the Application, as specified in this Agreement or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services in connection with the Application. For support, contact info@applinki.com.

10. Product Claims

The Company, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

11. Intellectual Property Infringement

In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

12. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

13. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the Application (for example, your wireless data service agreement, the Apple Media Services Terms, or the Google Play Terms of Service).

14. Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.

15. Termination

This Agreement is effective until terminated by you or the Company. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies from your devices.

16. Changes to this Agreement

The Company reserves the right to modify this Agreement at any time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, through the Application. Your continued use of the Application after such changes constitutes your acceptance of the revised Agreement.

17. Governing Law

This Agreement is governed by the laws of Switzerland (Canton of Bern), without regard to its conflict of law principles. Any dispute arising out of or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of Switzerland (Canton of Bern), except where prohibited by applicable consumer protection laws.

18. Translations

This Agreement is provided in English. Translations into other languages may be made available for convenience; in the event of any discrepancy between the English version and any translated version, the English version shall prevail.
